Special counsel Robert Mueller, breaking a two-year silence on his investigation into ties between Russia and the Trump campaign, says charging a president with a crime was "not an option" his team could consider in the Russia investigation.

Mueller says that he was bound by long-standing Justice Department opinions that say a president can't be indicted while in office.

In his first public comments in the probe, Mueller said on Wednesday "it would be unfair" to potentially accuse someone of a crime when the person couldn't stand trial to defend himself.

Mueller's comments echoed the findings in his public report.

Mueller's report revealed that US President Donald Trump tried to seize control of the Russia probe and force Mueller's removal to stop him from investigating potential obstruction of justice by the Republican president.

Trump has called the investigation a "witch hunt."

I'm speaking out today because our investigation is complete. The attorney general has made the report on our investigation largely public. We are formally closing the special counsel's office and as well, I'm resigning from the Department of Justice to return to private life. I'll make a few remarks about the results of our work, but beyond these few remarks it is important that the office's written work speak for itself. Let me begin where the appointment order begins and that is interference in the 2016 presidential election. As alleged by the grand jury in an indictment, Russian intelligence officers, who were part of the Russian military, launched a concerted attack on our political system. The indictment alleges that they use sophisticated cyber techniques to hack into computers and networks used by the Clinton campaign. They stole private information and then released that information through fake online identities and through the organization WikiLeaks. The releases were designed and timed to interfere with our election and to damage a presidential candidate. And at the same time, as the grand jury alleged in a separate indictment, a private Russian entity engaged in a social media operation where Russian citizens posed as Americans in order to influence an election. These indictments contain allegations and we are not commenting on the guilt or the innocence of any specific defendant. Every defendant is presumed innocent unless and until proven guilty. The indictments allege and the other activities in our report describe efforts to interfere in our political system. They needed to be investigated and understood and that is among the reasons why the Department of Justice established our office. That is also a reason we investigated efforts to obstruct the investigation.  The matters we investigated were of paramount importance. It was critical for us to obtain full and accurate information from every person we questioned. When a subject of an investigation obstructs that investigation or lies to investigators, it strikes at the core of the government's effort to find the truth and hold wrongdoers accountable. Let me say a word about the report. The report has two parts, addressing the two main issues we were asked to investigate. The first volume of the report details numerous efforts emanating from Russia to influence the election. This volume includes a discussion of the Trump campaign's response to this activity as well as our conclusion that there was insufficient evidence to charge a broader conspiracy. And in the second volume, the report describes the results and analysis of our obstruction of justice investigation involving the president. The order appointing me Special Counsel authorized us to investigate actions that could obstruct the investigation. We conducted that investigation and we kept the office of the acting attorney general apprised of the progress of our work and as set forth in the report, after that investigation, if we had had confidence that the president clearly did not commit a crime we would have said so. We did not however make a determination as to whether the president did commit a crime. The introduction to the volume 2 of our report explains that decision. It explains that under long standing department policy a president cannot be charged with a federal crime while he is in office. That is unconstitutional. Even if the charge is kept under seal and hidden from public view, that too is prohibited. The special counsel's office is part of the Department of Justice and by regulation it was bound by that department policy.  Charging the president with a crime was therefore not an option we could consider."

House Judiciary Chairman Jerrold Nadler said his committee is filing a court petition Friday in an effort to obtain secret grand jury material underlying former special counsel Robert Mueller's report.

The panel is also expected to file a lawsuit next week to try to enforce a subpoena against former White House counsel Donald McGahn, a key Mueller witness, if he doesn't comply before then.

That suit is expected to challenge the White House's claim that former White House employees have "absolute immunity" from testifying before Congress.

The move comes after Mueller's testimony Wednesday to Congress saying he had not "exculpated" President Donald Trump. Democrats are trying to focus public attention on Mueller's words and on his 448-page report's contents, including several episodes in which Trump sought to influence the special counsel's investigation into Russia election interference.

Mueller concluded that he could not exonerate Trump on obstruction of justice. He also concluded that there was no evidence of a criminal conspiracy between Trump's campaign and Russia.

The panel has struggled to bring in witnesses like McGahn who spoke extensively to Mueller because the White House has directed them to refuse to testify. Trump has said he will fight "all of the subpoenas."

Nadler said the committee is still negotiating with McGahn for documents and testimony, and the committee will file the lawsuit "in very short order" if he does not comply.

The court battles are beginning as the House leaves for a six-week recess and Democrats are debating whether to impeach the Republican president. More than 90 House Democrats have said they favor starting the impeachment process, but House Speaker Nancy Pelosi has said she wants to build the strongest case possible before making that decision, including by going to court to force witnesses to comply.

Nadler said the court filing will include a line saying that the materials are necessary "to determine whether the committee should recommend articles of impeachment."

Special counsel Robert Mueller is set to give the first public insight into how much information President Donald Trump's former national security adviser has shared with prosecutors in the Russia investigation.

The special counsel is facing a Tuesday deadline in Michael Flynn's case to file a memorandum recommending a sentence and providing a federal judge with a description of how valuable the retired U.S. Army lieutenant general has been to the probe.

The deadline comes ahead of Flynn's Dec. 18 sentencing and more than a year after he pleaded guilty to lying to the FBI about reaching out to Russian government officials on Trump's behalf.

Federal sentencing guidelines recommend between zero and six months in prison for Flynn, leaving open the possibility of probation.

The detailing of at least some of Flynn's cooperation also comes as Trump has increasingly vented his anger at the probe - and at one of his former confidantes who cooperated with it.

Private tensions between Justice Department leaders and special counsel Robert Mueller's team broke into public view in extraordinary fashion Wednesday as Attorney General William Barr pushed back at complaints over his handling of the Trump-Russia investigation report and aimed his own criticism at the special counsel.

Testifying for the first time since releasing Mueller's report, Barr said he was surprised Mueller did not reach a conclusion on whether President Donald Trump had tried to obstruct justice, and that he felt compelled to step in with his own judgment that the president had committed no crime.

The airing of disagreements over the handling of the report was notable given the highly secretive nature of the special counsel's investigation and the public appearance for at least most of the probe that the Justice Department and Mueller's team were unified in approach.

But Barr sought to minimize the rift by suggesting the special counsel's concerns were largely about process, not substance.

Barr's appearance Wednesday before the Senate Judiciary Committee gave him his most extensive opportunity to explain the department's actions, including his news conference held before the Mueller report's release.

It was also a forum for him to repair a reputation bruised by allegations that he's the Republican president's protector and by the emergence of a private letter from Mueller that criticized his handling of the report.

Democrats seized on the daylight between the two men to attack Barr's credibility and accuse him of unduly spinning Mueller's report in the president's favor.

They also pressed him on whether he had misled Congress last month when he professed ignorance about complaints from the special counsel's team. Barr suggested he had not lied because he was in touch with Mueller himself and not his team.

"Mr. Barr, I feel your answer was purposely misleading, and I believe others do too," said Sen. Patrick Leahy, D-Vt.

While Democratic senators bluntly questioned Barr's actions, Republicans, in addition to defending Trump, focused on the president's 2016 Democratic opponent Hillary Clinton's email and campaign practices and what they feel is a lack of investigation of them.

Neither side broke much ground Wednesday on the specifics of Mueller's investigation, though Barr did articulate a robust defense of Trump as he made clear his firm conviction that there was no prosecutable case against the president for obstruction of justice.

Barr entered the hearing on the defensive following reports hours earlier that Mueller had complained to him in a letter and over the phone about the way his findings were being portrayed.

Two days after receiving Mueller's report, Barr released a four-page letter that summarized the main findings.

Mueller's letter, dated March 27, conveys his unhappiness that Barr released what the attorney general saw as the bottom-line conclusions of the special counsel's investigation and not the introductions and executive summaries that Mueller's team had prepared and believed conveyed more nuance and context than Barr's own letter. Mueller said he had communicated the same concern two days earlier.

Once Mueller submitted his report, his work was done and the document was "my baby," Barr insisted defiantly.

"It was my decision how and when to make it public. Not Bob Mueller's," he said.

On Tuesday, the House has scheduled the vote to authorize lawsuits against Barr and former White House counsel Donald McGahn for failing to comply with subpoenas from the Democratic-controlled House. The vote will put the full House on record approving the lawsuits, if leaders and committees decide they want to move forward with them.

Educating the American public on what is in the Mueller report is a priority for Democrats, who believe Trump and his allies have created the public impression that the report said there was no obstruction of justice.

Trump has made that assertion repeatedly, echoing Barr's judgment that there was not enough evidence in the report to support a criminal obstruction charge. Mueller said in the report that he could not exonerate Trump on that point.

House Judiciary Committee Chairman Jerry Nadler rebuked President Donald Trump and former White House Counsel Don McGahn for defying a subpoena for McGahn's testimony before the committee Tuesday.

President Donald Trump directed McGahn to ignore the committee's subpoena to testify. A lawyer for McGahn said he would follow the president's directive.

House Judiciary Committee Chairman Jerrold Nadler said the committee will vote to hold McGahn in contempt of Congress if he did not testify.

It is one of several actions against current and former members of the administration as Trump has said he will fight "all of the subpoenas."

House Republicans interviewed James Comey behind closed doors Friday, hauling the former FBI director to Capitol Hill one final time before they cede power to Democrats in January.

In remarks to reporters, Comey said he expected to come back and testify again adding that he thought the hearing should have been open.

"When you read the transcript you will see that we are talking again about Hillary Clinton's emails, for heaven's sake," he said.

House Republicans are questioning Comey on decisions made by the Justice Department during the 2016 presidential election. Democrats will also attend the interview.

Republicans argue that department officials were biased against Donald Trump as they started an investigation into his campaign's ties with Russia and cleared Democrat Hillary Clinton in a separate probe into her email use.

Earlier, Republican lawmakers who stepped outside while the questioning was underway indicated they weren't satisfied and might try to bring him back another day.

"I was going to try and sneak by you, but I thought you might notice me.  Yeah, I'm coming back.  We have scheduled a date to come back on the 17th.  After a full day of questioning, two things are clear to me.  One we could have done this in open setting and two, when you read the transcript you will see that we are talking again about Hillary Clinton's emails, for heaven's sake. So, I'm not sure we need to do this at all. But I'm trying to respect the institution and to answer questions in a respectful way. You'll see I did that in the transcript.  You'll see that if you get a transcript of my return visit, which I think will be week after next and then this will be over totally.

Reporter: Mr. Comey you served in the Southern District of New York when the new attorney general nominee served as attorney general the last time.  Do you have confidence that he can act with impartiality if he's confirmed to this post?

I like and respect Bill Barr. I know he's an institutionalist who cares deeply about the integrity of the Justice Department. So I'm sure he'll use the standard career resources he has to judge what he should be involved in what he shouldn't be involved in.  But Bill Barr is a is a talented person who was a good attorney general the first time.  I liked him very much then, I think he'll serve the Justice Department well.  And I'm sure he'll talk to the career officials about how to handle that."

Reporter: How extensively have you cooperated with the Mueller investigation at this point?

I can't talk about that. I can't talk about, I mean I could but I won't. I'm sorry.

Reporter: The Republicans came out and said that the government lawyers ran interference and essentially shut down specific lines of questioning.  Did that happen, and if so what topics were not discussed?

One, you read the transcript and I think you will not see that happening.

Reporter: There specific topics that we still feel like you can't discuss from your time as FBI director?  You have been out the door for a year and a half now.  What can't you answer?

Well the FBI, for understandable reasons, doesn't want me talking about the details of the investigation that is still ongoing. It began when I was FBI director, so it makes sense that they don't want me going into those details but that's a very teeny part of what we talked about today.  A whole lot of Hillary Clinton's emails, which will bore you.

Reporter: The next time the hearing will be public? Is there any talk of that?

There wasn't a talk about. I think they want to do it the same way. I wish it were going to be public. But I think we're going to do it the same way again.

Reporter: You said you were OK with the Barr nominations.  Did you have any concerns about the firing of Jeff Sessions and the president continually going after Jeff Sessions for not recusing himself from the Mueller investigation?

The president's attacks on the Justice Department broadly and the FBI are something that no matter what political party you're in you should find deeply troubling and continue to speak out about not become numb to attacks on the rule of law.

Reporter: But with the firing of sessions specifically?

That's not something I can comment on.

Reporter: Director Comey can I ask you a question on FISA abuse, this the major issue for the Republicans. Did you have total confidence in the dossier when you used it to secure a surveillance warrant and also in the subsequent renewals?

I have total confidence that the FISA process was followed and that the entire case was handled in a thoughtful responsible way by DOJ and the FBI. I think the notion that FISA was abused here is nonsense.

Reporter: As a private citizen how do you think Bob Mueller's investigation is going?

As a private citizen, as someone who knows the justice system, I see it proceeding incredibly quickly and very, very professionally. But the most important indication of that is you don't know anything about it except when you file something in court and that's the way it should be.

Reporter: Are you prepared to return next year when Democrats regain control of Congress to testify, perhaps on the questions of obstruction of justice an impeachment case?

I always want to respect the institution of Congress. I'd love it if they didn't want me to testify but if they want me to testify and we can do it in a responsible way I will abide it. So we'll see what happens.

Reporter: "You know anything about Rod Rosenstein wearing a wire? Did that ever come up in any of the discussions when you were there?
