House Judiciary Chairman Jerrold Nadler said his committee is filing a court petition Friday in an effort to obtain secret grand jury material underlying former special counsel Robert Mueller's report.

The panel is also expected to file a lawsuit next week to try to enforce a subpoena against former White House counsel Donald McGahn, a key Mueller witness, if he doesn't comply before then.

That suit is expected to challenge the White House's claim that former White House employees have "absolute immunity" from testifying before Congress.

The move comes after Mueller's testimony Wednesday to Congress saying he had not "exculpated" President Donald Trump. Democrats are trying to focus public attention on Mueller's words and on his 448-page report's contents, including several episodes in which Trump sought to influence the special counsel's investigation into Russia election interference.

Mueller concluded that he could not exonerate Trump on obstruction of justice. He also concluded that there was no evidence of a criminal conspiracy between Trump's campaign and Russia.

The panel has struggled to bring in witnesses like McGahn who spoke extensively to Mueller because the White House has directed them to refuse to testify. Trump has said he will fight "all of the subpoenas."

Nadler said the committee is still negotiating with McGahn for documents and testimony, and the committee will file the lawsuit "in very short order" if he does not comply.

The court battles are beginning as the House leaves for a six-week recess and Democrats are debating whether to impeach the Republican president. More than 90 House Democrats have said they favor starting the impeachment process, but House Speaker Nancy Pelosi has said she wants to build the strongest case possible before making that decision, including by going to court to force witnesses to comply.

Nadler said the court filing will include a line saying that the materials are necessary "to determine whether the committee should recommend articles of impeachment."

US House Judiciary Committee Chairman Jerrold Nadler said former Trump campaign manager Corey Lewandowski remained obligated to answer the committee's questions, despite a White House order that he not discuss his confidential conversations with the president.

Lewandowski is testifying at the committee's first official hearing in what the panel is calling an impeachment investigation.

The White House sent Nadler a letter late Monday saying that Lewandowski was not allowed to discuss his conversations with President Donald Trump beyond what is already public in former special counsel Robert Mueller's report.

Nadler said in a letter back to the White House on Tuesday that Nadler must answer questions because the committee has subpoenaed him.

Mueller's investigators detailed two episodes in which Trump asked Lewandowski to direct then-Attorney General Jeff Sessions to limit Mueller's investigation.

The Republican members of the committee accused the chairman that the hearing wasn't really about finding out information.

"My majority made a promise, we'll impeach him, we'll investigating," said ranking member Rep. Doug Collins.

"For most of them it happened in November 2016 because they couldn't believe the Donald Trump won. And they still can't get over it today."

Republicans accused U.S. law enforcement leaders Thursday of withholding important documents from them and demanded details about surveillance tactics during the Russia investigation in a contentious congressional hearing that capped days of mounting partisan complaints.

The hearing Thursday was Deputy Attorney General Rod Rosenstein's first appearance before Congress since an internal Justice Department report that criticized the FBI's handling of the Hillary Clinton email investigation and revealed disparaging text messages among FBI officials about President Donald Trump during the 2016 election.

Republicans on the House Judiciary Committee suggested the department has conspired against Trump by refusing to turn over documents they believe would show improper conduct by the FBI.

They seized on the inspector general report to allege bias against the president by the FBI and to discredit an investigation into potential ties between Russia and the Trump campaign that is now led by special counsel Robert Mueller.

"This country is being hurt by it. We are being divided," Rep. Trey Gowdy, a South Carolina Republican, said of the investigation. He later added: "Whatever you got, finish it the hell up because this country is being torn apart."

Thursday's hearing came as the House prepared to vote on a resolution that demands the department turn over thousands of documents by July 6 on FBI investigations into Clinton's private email use and Trump campaign ties to Russia.

Those documents have already been subpoenaed by the House Judiciary and intelligence committees, which want to use the records as part of multiple investigations the FBI's decision to clear Clinton in the email investigation and to open an investigation into potential coordination between the Trump campaign and Russia.

Justice and FBI have already turned over more than 800,000 documents to congressional committees, but the subpoenas are asking for additional materials, including records about any surveillance of Trump campaign associates. Lawmakers have threatened to hold top Justice officials in contempt or impeach them if the documents aren't turned over.

Wray and Rosenstein said law enforcement officials have been working diligently to turn over the requested records, though Republicans made clear their dissatisfaction at the pace.

"We have caught you hiding information, Mr. Rosenstein," said Rep. Jim Jordan of Ohio. Rosenstein strongly denied the accusation.

Republican Rep. Ron DeSantis of Florida demanded to know why Rosenstein had not recused from oversight of special counsel Robert Mueller's investigation into whether the president had committed obstruction of justice given Rosenstein's role in laying the groundwork for the firing of FBI Director James Comey.

Rosenstein wrote a memo last year criticizing Comey's handling of the Clinton email investigation, a document the White House initially held up as the rationale for his firing.

"I can assure you that if it were appropriate for me to recuse, I'd be more than happy to do so," Rosenstein said.

Thursday's hearing came as the House prepared to vote on a resolution that demands the department turn over thousands of documents by July 6 on FBI investigations into Clinton's private email use and Trump campaign ties to Russia.

Those documents have already been subpoenaed by the House Judiciary and intelligence committees, which want to use the records as part of multiple investigations the FBI's decision to clear Clinton in the email investigation and to open an investigation into potential coordination between the Trump campaign and Russia.

Justice and FBI have already turned over more than 800,000 documents to congressional committees, but the subpoenas are asking for additional materials, including records about any surveillance of Trump campaign associates. Lawmakers have threatened to hold top Justice officials in contempt or impeach them if the documents aren't turned over.

Wray and Rosenstein said law enforcement officials have been working diligently to turn over the requested records, though Republicans made clear their dissatisfaction at the pace.

"We have caught you hiding information, Mr. Rosenstein," said Rep. Jim Jordan of Ohio. Rosenstein strongly denied the accusation.

Republican Rep. Ron DeSantis of Florida demanded to know why Rosenstein had not recused from oversight of special counsel Robert Mueller's investigation into whether the president had committed obstruction of justice given Rosenstein's role in laying the groundwork for the firing of FBI Director James Comey.

Rosenstein wrote a memo last year criticizing Comey's handling of the Clinton email investigation, a document the White House initially held up as the rationale for his firing.

Republicans accused U.S. law enforcement leaders Thursday of withholding important documents from them and demanded details about surveillance tactics during the Russia investigation in a contentious congressional hearing that capped days of mounting partisan complaints.

The hearing Thursday was Deputy Attorney General Rod Rosenstein's first appearance before Congress since an internal Justice Department report that criticized the FBI's handling of the Hillary Clinton email investigation and revealed disparaging text messages among FBI officials about President Donald Trump during the 2016 election.

Republicans on the House Judiciary Committee suggested the department has conspired against Trump by refusing to turn over documents they believe would show improper conduct by the FBI.

House Judiciary Committee Chairman Jerrold Nadler says former Trump campaign manager Corey Lewandowski remains obligated to answer the committee's questions despite a White House order that he not discuss his confidential conversations with the president.

Lewandowski is testifying at the committee's first official hearing in what the panel is calling an impeachment investigation.

The White House sent Nadler a letter late Monday saying that Lewandowski was not allowed to discuss his conversations with President Donald Trump beyond what is already public in former special counsel Robert Mueller's report.

Nadler said in a letter back to the White House on Tuesday that Nadler must answer questions because the committee has subpoenaed him.

Mueller's investigators detailed two episodes in which Trump asked Lewandowski to direct then-Attorney General Jeff Sessions to limit Mueller's investigation.

The Republican members of the committee accused the chairman that the hearing wasn't really about finding out information.

"My majority made a promise, we'll impeach him, we'll investigating," said ranking member Rep. Doug Collins.

The top Democrat on the Senate intelligence panel, Virginia Sen. Mark Warner, would not comment on whether the panel had issued a subpoena to Donald Trump Jr. but said the committee is going to "follow the truth wherever it leads."

Two people familiar with the subpoena who discussed it on condition of anonymity say the Senate intelligence committee has subpoenaed Trump Jr., calling him in to answer questions about his 2017 testimony to the panel as part of its probe into Russian election interference.

It's the first known subpoena of a member of President Donald Trump's immediate family, and a new sign that the Senate panel is continuing with its own Russia investigation even after the release of special counsel Robert Mueller's report on the same subject.

It's unclear if Trump Jr. will comply with the subpoena from the committee, which is chaired by Republican Sen. Richard Burr of North Carolina.

A person close to the president's eldest son, who requested anonymity to discuss the matter, said Wednesday that Trump has continued to cooperate by producing documents and answering written questions.

Warner, said the committee reserves the right to call witnesses back if they see inconsistencies in testimony. Warner made the comments at a breakfast Thursday hosted by the Christian Science Monitor.

Warner said that the intelligence panel also wants to see the underlying evidence in Mueller's report, a request that House lawmakers have also made. Trump on Wednesday invoked the principle of executive privilege over that material, claiming the right to block lawmakers from receiving it.

Warner said his panel knew about "90 to 95 percent" of the Russian contacts mentioned in Mueller's report, and in other areas the committee had "much more extensive" information.

Supreme Court nominee Brett Kavanaugh says a 1973 Supreme Court decision that established a constitutional right to an abortion is an "important precedent" that has "been reaffirmed many times."

Kavanaugh was asked about the Roe v. Wade ruling by Democrat Dianne Feinstein of California. He said the decision has "been reaffirmed many times over the past 45 years." And he noted that a 1992 decision of the court called Planned Parenthood v. Casey didn't just reaffirm Roe v. Wade in passing. He said that decision becomes "precedent on precedent."

Kavanaugh compared the Roe decision to another case, Miranda v. Arizona, which requires law enforcement to tell suspects their rights. Kavanaugh noted that former Chief Justice William Rehnquist had been a critic of the Miranda decision but later upheld it as precedent.

Kavanaugh also refused to say whether a president can be forced to testify in a criminal case, calling it a hypothetical.

"More than a year ago, White House counsel Don McGahn sat for the first of several interviews with Special Counsel Robert Mueller. Over the course of those interviews, he described how the president directed him to have the special counsel fired. He described how the president ordered him to lie about it. He described several other obstructive incidents outlined in the special counsel's report.  The president, in contrast, refused to be interviewed by the special counsel, or even to answer written questions about his attempts to obstruct the investigation. In short the president took it upon himself to intimidate a witness who has a legal obligation to be here today. This conduct is not remotely acceptable."

"Let me be clear. This committee will hear Mr. McGahn's testimony even if we have to go to court to secure it. We will not allow the president to prevent the American people from hearing from this witness. We will not allow the president to block congressional subpoenas, putting himself and his allies above the law. We will not allow the president to stop this investigation and nothing in these unjustified and unjustifiable legal attacks will stop us from pressing forward with our work on behalf of the American people. We will hold this president accountable one way or the other."

STORYLINE:

House Judiciary Committee Chairman Jerry Nadler rebuked President Donald Trump and former White House Counsel Don McGahn for defying a subpoena for McGahn's testimony before the committee Tuesday.

President Donald Trump directed McGahn to ignore the committee's subpoena to testify. A lawyer for McGahn said he would follow the president's directive.

House Judiciary Committee Chairman Jerrold Nadler said the committee will vote to hold McGahn in contempt of Congress if he did not testify.

It is one of several actions against current and former members of the administration as Trump has said he will fight "all of the subpoenas."

McGahn was a key witness in the investigation of special counsel Robert Mueller.
