Democrats on the House Judiciary Committee issued a stern warning to President Donald Trump on Thursday: "If you shut down or throttle" the investigation into Russian meddling led by special prosecutor Robert Mueller, "you will plunge this country into a constitutional crisis."

New York Democratic Rep. Jerry Nadler continued, "Mr. President, we are watching you. The American people are watching you."

Many House Democrats called for legislation to protect the special counsel to be included in the spending bill Congress must pass by Friday to keep the government running.

Republicans didn't agree to the measure, however, and the provision was not included.

Asked if firing Mueller was a "red line" that could lead to impeachment, Rep. Nadler stopped short of predicting the consequences, saying only, "all options would be on the table."

Nadler said the firing of the special counsel would lead to a "sea change in the political landscape of the country," that would cause Republicans "to be moved to act" against the president, too.

But he said, "We're not there yet."

Elaine Kamarck, of the Brookings Institution says "we're pretty much at the end of this process" as she discussed the next steps in the special prosecutors Russia probe.

House Judiciary Chairman Jerrold Nadler said his committee is filing a court petition Friday in an effort to obtain secret grand jury material underlying former special counsel Robert Mueller's report.

The panel is also expected to file a lawsuit next week to try to enforce a subpoena against former White House counsel Donald McGahn, a key Mueller witness, if he doesn't comply before then.

That suit is expected to challenge the White House's claim that former White House employees have "absolute immunity" from testifying before Congress.

The move comes after Mueller's testimony Wednesday to Congress saying he had not "exculpated" President Donald Trump. Democrats are trying to focus public attention on Mueller's words and on his 448-page report's contents, including several episodes in which Trump sought to influence the special counsel's investigation into Russia election interference.

Mueller concluded that he could not exonerate Trump on obstruction of justice. He also concluded that there was no evidence of a criminal conspiracy between Trump's campaign and Russia.

The panel has struggled to bring in witnesses like McGahn who spoke extensively to Mueller because the White House has directed them to refuse to testify. Trump has said he will fight "all of the subpoenas."

Nadler said the committee is still negotiating with McGahn for documents and testimony, and the committee will file the lawsuit "in very short order" if he does not comply.

The court battles are beginning as the House leaves for a six-week recess and Democrats are debating whether to impeach the Republican president. More than 90 House Democrats have said they favor starting the impeachment process, but House Speaker Nancy Pelosi has said she wants to build the strongest case possible before making that decision, including by going to court to force witnesses to comply.

Nadler said the court filing will include a line saying that the materials are necessary "to determine whether the committee should recommend articles of impeachment."

A legal scholar says that the the battle between the Democrat-led House and President Donald Trump over special counsel Robert Mueller's report could lead to a constitutional crisis.

Victoria Nourse, a professor at Georgetown Law University, views the Trump administration as "the most combative" since former President Richard Nixon.

Nourse, who has served both Republicans and Democrats as a legal counsel, says that the current battle between Trump and House Republicans could end up in court.

While she believes that there is legal precedent that defends Congress' ability to request documents, Trump could ultimately decide not to comply with any judicial ruling.

"My biggest fear is that if it were to go to court and the court were to affirm Congress' authority that the president would simply refuse," Nurse said, referring to potential contempt proceedings against Attorney General Bill Barr and subpoenas House Democrats have threatened to issue over a number of investigations.  

"That would be a true constitutional crisis because in fact you would have one branch saying to the other branch, the courts, 'I'm not going to pay attention to you,' in which case there is no way to resolve that. The White House is again directing former employees not to cooperate with a congressional investigation, this time instructing former aides Hope Hicks and Annie Donaldson not to provide documents to the House Judiciary Committee.

The letters from the White House to the Judiciary panel are the latest effort by the White House to thwart congressional investigations into President Donald Trump.

Trump has said he will fight "all of the subpoenas" as Democrats have launched multiple probes into his administration and personal financial affairs.

House Judiciary Chairman Jerrold Nadler issued subpoenas for Hicks, former White House communications director, and Donaldson, a former aide in the White House Counsel's Office, last month.

Both are mentioned frequently in special counsel Robert Mueller's report.

The White House has claimed executive privilege over documents and testimony, invoking the power to keep information from the courts, Congress and the public to protect the confidentiality of the Oval Office decision-making process.

But that only extends so far. Nadler said in a statement Tuesday that, while the White House had instructed the former aides not to turn over materials, Hicks had agreed to turn over documents related to her time on Trump's presidential campaign. Those materials are not covered by executive privilege.

Nadler said he thanked Hicks for "that show of good faith."

The committee is arguing that the documents would not be covered by executive privilege if they left the White House months ago.

The White House has also directed former White House counsel Donald McGahn to refuse to provide documents or testify before the committee.

The House is expected to vote to hold McGahn and Attorney General William Barr, who has refused to turn over the full Mueller report, in contempt of Congress next week.

The White House is again directing former employees not to cooperate with a congressional investigation, this time instructing former aides Hope Hicks and Annie Donaldson not to provide documents to the House Judiciary Committee.

The letters from the White House to the Judiciary panel are the latest effort by the White House to thwart congressional investigations into President Donald Trump.

Trump has said he will fight "all of the subpoenas" as Democrats have launched multiple probes into his administration and personal financial affairs.

House Judiciary Chairman Jerrold Nadler issued subpoenas for Hicks, former White House communications director, and Donaldson, a former aide in the White House Counsel's Office, last month.

Both are mentioned frequently in special counsel Robert Mueller's report.

The White House has claimed executive privilege over documents and testimony, invoking the power to keep information from the courts, Congress and the public to protect the confidentiality of the Oval Office decision-making process.

But that only extends so far. Nadler said in a statement Tuesday that, while the White House had instructed the former aides not to turn over materials, Hicks had agreed to turn over documents related to her time on Trump's presidential campaign. Those materials are not covered by executive privilege.

Nadler said he thanked Hicks for "that show of good faith."

The committee is arguing that the documents would not be covered by executive privilege if they left the White House months ago.

The White House has also directed former White House counsel Donald McGahn to refuse to provide documents or testify before the committee.

The House is expected to vote to hold McGahn and Attorney General William Barr, who has refused to turn over the full Mueller report, in contempt of Congress next week.

House Speaker Nancy Pelosi told reporters that she agrees with House Judiciary Committee Chairman Jerry Nadler that the U.S. is in a "constitutional crisis" because the Trump administration refuses to comply with subpoenas issued by House committees.

Pelosi also says the House isn't rushing into a vote on holding Attorney General William Barr in contempt of Congress for not providing special counsel Robert Mueller's full report on his Russia investigation.

The California Democrat told reporters Thursday she'll follow a methodical process, saying, "We won't go any faster than the facts take us or any slower than the facts take us."

Pelosi spoke at her weekly news conference a day after the Democrat-led House Judiciary Committee approved a contempt citation against Barr for failing to comply with a subpoena for the full report and underlying evidence.

Judiciary Chairman Jerrold Nadler said the House will vote on the contempt citation "soon," but said the date is still to be determined.

Pelosi said she is waiting for other developments, including whether Mueller testifies to Nadler's committee.
